Mote will only share user data - including student data - with third parties whose privacy policies are consistent with Mote's own policies as described herein. Mote does not sell personal information and does not collect, use or share such information for any purposes other than to provide the Mote service to you. Mote does not engage in advertising of any kind targeting minors, and in particular does not engage in behavorial targeting of advertising to minors.
Information about your computer hardware and software may be automatically collected by Mote. This information is used for the operation of the service, to maintain quality of the service, and to provide general statistics regarding use of the Mote website. Wherever possible and practicable, we will anonymize IP addresses using such methods as, by way of example only, removing the last three digits.

Mote securely stores your personal information from unauthorized access, use, or disclosure at our Cloud Storage service provider, Amazon Web Services, in Oregon, USA. Mote uses the following methods for this purpose: - SSL Protocol and password protection of all data storage systems. When personal information (such as a credit card number) is transmitted to other websites, it is protected through the use of encryption, such as the Secure Sockets Layer (SSL) protocol.

Mote takes various security measures—physical, electronic, and procedural—to help defend against the unauthorized access, alteration and/or disclosure of your personal information. Mote Technologies, Inc. complies with the EU-U.S. Data Privacy Framework (EU-U.S. DPF) and the UK Extension to the EU-U.S. DPF (“the framework”) as set forth by the U.S. Department of Commerce. Mote Technologies, Inc. has certified to the U.S. Department of Commerce that it adheres to the EU-U.S. Data Privacy Framework Principles (EU-U.S. DPF Principles) with regard to the processing of personal data received from the European Union in reliance on the EU-U.S. DPF and from the United Kingdom (and Gibraltar) in reliance on the UK Extension to the EU-U.S. DPF. Mote reserves the right at all times to disclose any information as necessary to satisfy any applicable law, regulation, legal process or governmental request, or to edit, refuse to post or to remove any information or materials, in whole or in part, in Mote's sole discretion.

By posting, uploading, inputting, providing or submitting your Submission you warrant and represent that you own or otherwise control all of the rights to your Submission as described in this section including, without limitation, all the rights necessary for you to provide, post, upload, input or submit the Submissions.
You are able to connect your Mote account to third party accounts, in particular to your Google account. By connecting your Mote account to your third party account, you acknowledge and agree that you are consenting to the continuous release of information about you to others (in accordance with your privacy settings on those third party sites).
The Service is controlled, operated and administered by Mote Technologies, Inc. (Delaware) from our offices within the USA. If you access the Service from a location outside the USA, you are responsible for compliance with all local laws. You agree that you will not use the Mote Content accessed through https://mote.com in any country or in any manner prohibited by any applicable laws, restrictions or regulations.
You agree to indemnify, defend and hold harmless Mote, its officers, directors, employees, agents and third parties, for any losses, costs, liabilities and expenses (including reasonable attorney's fees) relating to or arising out of your use of or inability to use the Site or services, any user postings made by you, your violation of any terms of this Agreement or your violation of any rights of a third party, or your violation of any applicable laws, rules or regulations. Mote reserves the right, at its own cost, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will fully cooperate with Mote in asserting any available defenses.
In the event the parties are not able to resolve any dispute between them arising out of or concerning these Terms and Conditions, or any provisions hereof, whether in contract, tort, or otherwise at law or in equity for damages or any other relief, then such dispute shall be resolved only by final and binding arbitration pursuant to the Federal Arbitration Act, conducted by a single neutral arbitrator and administered by the American Arbitration Association, or a similar arbitration service selected by the parties, in a location mutually agreed upon by the parties. The arbitrator's award shall be final, and judgment may be entered upon it in any court having jurisdiction. In the event that any legal or equitable action, proceeding or arbitration arises out of or concerns these Terms and Conditions, the prevailing party shall be entitled to recover its costs and reasonable attorney's fees. The parties agree to arbitrate all disputes and claims in regards to these Terms and Conditions or any disputes arising as a result of these Terms and Conditions, whether directly or indirectly, including Tort claims that are a result of these Terms and Conditions. The parties agree that the Federal Arbitration Act governs the interpretation and enforcement of this provision. The entire dispute, including the scope and enforceability of this arbitration provision shall be determined by the Arbitrator. This arbitration provision shall survive the termination of these Terms and Conditions.
Any arbitration under these Terms and Conditions will take place on an individual basis; class arbitrations and class/representative/collective actions are not permitted. THE PARTIES AGREE THAT A PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN EACH'S INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PUTATIVE CLASS, COLLECTIVE AND/ OR REPRESENTATIVE PROCEEDING, SUCH AS IN THE FORM OF A PRIVATE ATTORNEY GENERAL ACTION AGAINST THE OTHER. Further, unless both you and Mote agree otherwise, the arbitrator may not consolidate more than one person's claims, and may not otherwise preside over any form of a representative or class proceeding.
THE INFORMATION, SOFTWARE, PRODUCTS, AND SERVICES INCLUDED IN OR AVAILABLE THROUGH THE SITE MAY INCLUDE INACCURACIES OR TYPOGRAPHICAL ERRORS. CHANGES ARE PERIODICALLY ADDED TO THE INFORMATION HEREIN. MOTE AND/OR ITS SUPPLIERS MAY MAKE IMPROVEMENTS AND/OR CHANGES IN THE SITE AT ANY TIME.
MOTE AND/OR ITS SUPPLIERS MAKE NO REPRESENTATIONS ABOUT THE SUITABILITY, RELIABILITY, AVAILABILITY, TIMELINESS, AND ACCURACY OF THE INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS CONTAINED ON THE SITE FOR ANY PURPOSE. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect. Unless otherwise specified herein, this agreement constitutes the entire agreement between the user and Mote with respect to the Site and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the user and Mote with respect to the Site. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. It is the express wish to the parties that this agreement and all related documents be written in English.
Mote reserves the right, in its sole discretion, to change the Terms under which The Site is offered, for example to reflect changes to the law or changes to our Services. The most current version of the Terms will supersede all previous versions, and we will notify you about material changes by sending a notice to the primary email address specified in your account, by placing a prominent notice on our site, and by updating this page.

Safeguarding the data of all Mote users is of foundational importance to our business. Our Privacy Policy and Terms of Service, developed to meet the most stringent legal and ethical requirements of educational users, guide and inform our data security policy and practices. Our core commitments to you are:
All access into, within Mote services and its contracted 3rd party suppliers uses TLS v1.2+ higher. All end-user facing services are hosted on AWS and provided through CloudFront and Elastic Load Balancer. We also use HTTP Strict Transport Security to ensure pages are served over secure connections.
All personally identifiable information (PII) which we directly manage in AWS DynamoDB, which itself encrypts at rest. Media (audio MP3s) is stored in AWS S3 and encrypted in transit through CloudFront. We contract billing services from Chargebee to manage credit card data, who provide similarly strong encryption in transit and at rest warranties. We use Amplitude for product analytics to understand our customers and improve our services, with annual SOC 2 Type 2 Certification and AES-256 encryption. Finally, we use Customer.io for email messaging (solely to 18+ users) who encrypt in transit.
Our services run inside AWS in a dedicated VPC, primarily on EC2 and DynamoDB, for which AWS assures compliance to the strictest security standards including ISO 27001, SOC2, PCI DSS Level 1 and FISMA with the help of external auditors. More details available at AWS
Our raw primary data store of PII is DynamoDB. Access to DynamoDB is restricted to essential operational staff who have undergone background checks. Where PII data is sent to downstream platforms, including Amplitude for product analytics and Customer.io for email communication, student data is anonymised and/or redacted to the greatest extent possible.
User data in DynamoDB is backed up using AWS built-in backup tools. Similarly, our media in S3 is backed up to buckets in different regions. Our EC2 servers run on redundant infrastructure with significant excess capacity for demand fluctuations.
Datadog is contracted for automated monitoring and alerting, and identification of service anomalies. We additionally use Sentry to assist in monitoring quality of user experience.
All service data resides in our own cloud or contracted 3rd party software-as-a-service cloud infrastructure.
Access to code, configuration and service data is restricted to current staff wht multi-factor authentication (MFA) provided by Google Workspace and Github. Access is differentiated by role with maximum restrictions being applied to DynamoDB user data store.
